These Terms of Use (“Terms”) govern your use of the Work Resilience, LLC SaaS platform at https://work-resilience.com (the “Platform”).
By accessing or using the Platform, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts.
2. Account Registration
You agree to:
Provide accurate information
Maintain confidentiality of login credentials
Notify us of unauthorized access
You are responsible for all activity under your account.
3. SaaS License Grant
Subject to compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purposes.
You may not:
Reverse engineer or decompile
Copy or redistribute software
Attempt unauthorized access
Use the Platform for unlawful purposes
4. Intellectual Property
All software, content, trademarks, branding, and technology remain the exclusive property of Work Resilience, LLC.
You retain ownership of content you upload but grant us a limited license to host and process it solely to provide services.
5. Acceptable Use
You agree not to:
Upload harmful or unlawful content
Interfere with security
Transmit malware
Engage in abusive behavior
We may suspend or terminate accounts at our discretion.
6. Disclaimers
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”
WE DISCLAIM ALL WARRANTIES, INCLUDING:
MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
We do not guarantee uninterrupted or error-free service.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
WORK RESILIENCE, LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.
OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT PAID BY YOU (IF ANY) IN THE PREVIOUS 12 MONTHS.
8. Indemnification
You agree to indemnify and hold harmless Work Resilience, LLC from claims arising from:
Your misuse of the Platform
Your violation of these Terms
Your violation of any law
9. Arbitration & Class Action Waiver
Any dispute arising from these Terms shall be resolved by binding arbitration in the State of Texas, under the rules of the American Arbitration Association.
You agree:
No class actions
No jury trials
Individual claims only
You may opt out of arbitration within 30 days of first using the Platform by sending written notice.
10. Termination
We may suspend or terminate access at any time for violation of these Terms.
11. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
12. Modifications
We may update these Terms at any time. Continued use constitutes acceptance.
